Obtaining a Temporary Residence Permit (TRP) in Poland

A temporary residence permit in Poland (“karta czasowego pobytu”) is a document that gives a foreigner permission to legally stay in Poland and is issued for a period of 3 months to 3 years. If the state authorities make a positive decision, the foreigner receives an official document - a temporary residence card.

Purposes for which you can obtain TRC in Poland

Work
 Work contract: If you have received a job offer from a Polish company, you can apply for a residence permit. The basic documents include a work contract and a work permit, if required.

 Secondment: If you work for an international company and are transferred to a Polish branch, it is possible to obtain a TRC on this basis.

Study
 University studies: A residence permit may be granted to students enrolled in Polish universities, colleges or other educational institutions. Proof of enrollment and proof of financial solvency are required.

Family reunification
 Marriage to a Polish citizen: If you are married to a Polish citizen, this can be the basis for obtaining TRC. A marriage certificate and proof of cohabitation are required.
 Family reunification: You can apply for TRC if your close relatives (spouse, children) reside in Poland on the basis of TRC or citizenship.

Running a business
 Setting up a business in Poland: Entrepreneurs starting their own business in Poland can obtain a TRC. It is necessary to submit a business plan, register the company and prove the availability of financial means to run the business.

Other grounds
 Staying in Poland can have various purposes, such as cultural and volunteer activities, scientific and research activities, medical treatment. If your purpose of stay does not fall under the standard categories but is legitimate and justified, you can try to obtain a TRC under individual conditions.

Obtaining a Permanent Residence Permit (PRС) in Poland

A permanent residence permit (karta stałego pobytu) is a document that is issued to a foreigner to legalize his/her permanent stay in Poland for an indefinite period of time, but is subject to replacement every 10 years without the need to prove the right to stay in the country. This permanent residence permit allows a foreigner to live, study and work in Poland with the same rights as Polish citizens, except for participation in elections.

Who can get a PRC in Poland?

Polish roots:
Foreigners who have Polish roots or a Pole's card can apply for a migrant visa. Such persons are considered to be native Poles if they have documents proving their ancestors' Polish roots. 

Marriage to a Polish citizen:
3 years of marriage and 2 years of residence in Poland on the basis of an hourly residence card or other document allowing legal stay in the country.

Period of residence in Poland:
Foreigners who have officially and continuously resided in Poland for more than 10 years.
Foreigners who have been officially employed for more than 4 years in professions that are included in the list of necessary and demanded professions.
Refugees (at least 5 years) and victims of the slave trade (at least 1 year) staying in Poland on the basis of a residence permit issued for the same reasons. 

Children can also apply for a "stalego pobytu" card:
Children born in marriage to citizens of the Republic of Poland.
Children born when the parent had a valid temporary residence permit or during his/her stay in Poland. In this case, these permits are considered humanitarian or related to the reception of refugees or a form of protection.

The Polish government is making significant efforts to create an efficient system for processing applications and issuing work and residence permits, including digitizing most processes. However, due to the heavy workload of the departments for foreigners (several hundred thousand residence permits are issued in Poland every year), the process of applying and obtaining a permit remains quite complicated and lasts for months and even years.
